Herdlo Terms and Conditions

1. Agreement and End-User Licence Agreement (EULA)

These Terms and Conditions (including the End-User Licence Agreement in Section 4) form a binding commercial agreement between Amber Louise Burch trading as Herdlo (ABN 95 861 964 295) and the business or practitioner using getherdlo.com or app.getherdlo.com. These Terms are balanced to comply with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including the small-business Unfair Contract Terms regime.

2. Plans, Deliverables and Pricing

  • Prices in AUD. Every price is shown before payment.
  • Free AI Visibility Check: samples 5 local customer searches across 3 AI engines (ChatGPT, Gemini and Perplexity) and double-checks every answer that names your business.
  • Fix Pack (A$197 one-off): starting visibility check, AI profile page on getherdlo.com live for 90 days, behind-the-scenes structured data and guided Google profile steps. Credited in full if you join any monthly plan within 60 days.
  • Monthly plans (Autopilot A$149/mo, Autopilot Plus A$249/mo, Suburb Lock A$399/mo): renew monthly on your billing date; cancel any time in one click in Billing and keep access until the paid period ends.
  • Suburb Lock carries a 3-month minimum term, shown before payment, to hold one spot per trade category per suburb cluster while active. You can still cancel online in Billing at any time with zero exit penalty fee, which releases the suburb cluster spot at the end of the paid period.

3. Onboarding Consents, 48-Hour Veto and Rollback

Herdlo auto-applies your AI profile page, behind-the-scenes info and directory listings from facts you confirm, and each change can be undone in one click. Google profile fixes arrive as simple guided steps for you to complete, and the checker re-verifies each one. During onboarding you choose between a 48-hour veto window (we email every update first so you can undo within 48 hours or roll back later) or manual approval on every change.

4. Intellectual Property, AHPRA Health Safeguards and AI Sampling

You retain 100% ownership of your business name, brand and confirmed facts, together with a perpetual licence to keep any structured data and reports generated for your website. For regulated health services under section 133 of the Health Practitioner Regulation National Law and AHPRA guidelines, Herdlo uses strictly factual directory details and neutral "mentioned in AI answers" wording. Results are sampled through AI providers' official APIs and reported with dates. AI answers vary over time.

5. 30-Day Refund Rule, Australian Consumer Law and Section 64A Cap

30-day money-back promise: Every payment comes with a 30-day refund. Press Refund me in Billing and we return that payment to your card. If you've used some of the Fix Pack credit on a plan, we return the amount paid minus the credit used. Where Fix Pack credit pays some or all of a plan payment, that payment's refund covers the part charged to your card; the Fix Pack payment has its own 30-day window from the day it was made. Our services come with statutory guarantees under sections 60 to 62 of the Australian Consumer Law. For commercial business services priced at A$100,000 or less, to the extent permitted by Section 64A of the Australian Consumer Law, liability is limited at our election to supplying the services again or paying the cost of having the services supplied again. Governed by the laws of Western Australia.
